Myanmar Trademark Registration Costs and Registration Procedures

The new Trade Mark Law was made public in July 2016, but it has not been adopted until now. Trademarks can be registered with the Myanmar Registration Office (Registry of Deeds and Assurances) by means of Declaration of Ownership at the Registration Office and publish a Cautionary Notice in the designated local newspaper for public awareness. Myanmar adopts first-to-use basis for trademark protection. The trademarks have to be re-registered and re-published every three years after first registration.

1.	Myanmar Trademark Registration Fees

Materials Required for Filing of Trademark Application in Myanmar

(1)	A Power of Attorney (to be provided by Kaizen) signed by the applicant, notarized before a Notary Public and legalized up to the Myanmar Embassy or Consulate in the applicant’s home country.
(2)	A Declaration of Ownership of Trademark (to be provided by Kaizen) simply signed by the applicant.
(3)	A soft copy of the trademark.
(4)	A duly completed Trademark Registration Order Form (to be provided by Kaizen).
(5)	A copy of Certificate of Incorporation or Business Registration Certificate or anything of similar nature which shows the name and address of the applicant.

Myanmar Trademark Application Procedures

(1)	Client sends to Kaizen (by email or fax or post) a specimen of the trademark together with the duly completed Trademark Registration Order Form and at the same time make payment for the pre-filing search;
(2)	Kaizen acknowledge the information like the mark, goods/services and apply class(es), then we will provide the latest quotation and preliminary advice;
(3)	Client confirms the quotation and make formal entrust. Kaizen will conduct the pre-filing search (if requested). The official search report will be sent to client within 15 working days;
(4)	If the search results indicate that the application is likely to be accepted and client decides to proceed, Kaizen will file trademark application to the Registry of Deeds and Assurances upon receipt of your payment and instruction;
(5)	The Registry of Deeds and Assurances will record the Declaration of Ownership of Trademark.
(6)	The representation of mark, class(es), item(s) and the information of the applicant will be published on the designated local newspaper.
(7)	A registration certificate will be issued by the Registry of Deeds and Assurances. We will review and send the certificate to you.

4.	Time scale
	Currently it takes around 1 - 2 months to get a trademark registered in Myanmar in a smooth case.

Payment Term and Payment Method

Our fees for each stage of an application are to be invoiced and settled before the commencement of each stage of service. If a China or Taiwan Value-Added Tax invoice is required, 7% or 5% additional charge will be incurred.

Refund Policy

No refund of fees will be made after the commencement of services. For example, if we have conducted a pre-filing search and found an identical mark is already in the register, the application will not be proceeded, the fees for pre-filing search will not be refunded. If we have already filed an application and the application is objected by the Registry of Deeds and Assurances or any other party or refused, there will not be any refunded of fees.

In case you have paid our fees for all three stages of an application and the search result indicates that an identical mark is already in the register, the application will not be proceeded. The fees for services not performed, i.e., filing for application and issuing of certificate of registration will be refunded, after deducting bank wiring charge.
